Abstract Agriculture is the basis of the national economy and the precondition of the country’s survive and development. Although our total amount of water resource is the sixth of the world because of the huge amount of population. China has been listed as one of the thirteen Water-shortage countries and one of the irrigation water shortage countries. Henan is the biggest agricultural province of China, and is also one of the serious water-shortage provinces in the North China. Its total amount of water resource only account for 1.4%of national total amount. It ranks the ninth in China and its per capita water resource is only the fifth of the national average level. Meanwhile, agriculture is suffering the huge loss because of the climate condition, geographical location and frequent occurrence of flood and drought disasters. In 2009, the drought disaster happened in Henan is the warning to the protection of irrigation water. The serious consequence of the disaster attracts the attention of the whole society. Therefore, how to scientifically develop and use irrigation water is becoming the key problem. Through the elaborate analysis, the writer finds that the basic problem of the water shortage is the unscientific development and usage of water. So we should find out the efficient solution to these problems from the prospect of law and provide the suggestions to the irrigation water protection which can be used for reference to the whole nation. The paper focus on the challenge and problems we are facing and the deep analysis on existed problems and related law control. It also put forward the ideas and measurements on law control based on the advance foreign experiences. The paper includes six parts which are introduction, four-part body and conclusion.
