笔者首先分析了社会习俗的独特性，提出习俗对法律的内容方面具有供给作用，
对法律的功能实现方面具有辅助作用，进而引发一个问题为什么类似北京《禁
放》规定的法律制度，用“粗暴”的方式取代社会习俗，为什么制定法会如此
漠视习俗的存在?笔者试图为这些问题给出答案，并且尝试建立一种习俗与国
家制定法的理性互动模式，来破开法律的困境中最牢固的一环。
