最高人民法院关于审理垄断民事纠纷案件适用法律若干问题的规定（征求意见稿）
Rules by the Supreme People’s Court on Certain Issues relating to
Application of Laws for Hearing Civil Monopoly Disputes (Draft for Comments)
为了正确审理垄断民事纠纷案件，制止垄断行为，保护市场自由和公平竞争，维护消费者利益和
社会公共利益，最高人民法院根据《中华人民共和国反垄断法》等法律，制定了《关于审理垄断
民事纠纷案件适用法律若干问题的规定（征求意见稿）》。《征求意见稿》涉及案件管辖、当事
人及诉讼方式、证据与证明责任、民事责任承担和诉讼时效等问题，共计20 条。为充分听取各方
意见，现就《征求意见稿》公开征求意见，欢迎社会各界提出修改意见和建议。有关意见和建议
的反馈截止日期为2011 年6 月1 日。
社会各界人士可以采取书面寄送或者在网上发表意见的方式，对该《征求意见稿》提出具体的修
改意见和建议。为便于充分理解和慎重考虑您所提建议，在提出建议时最好附带说明修改建议或
者意见的具体理由。书面意见可寄北京市东城区东交民巷27 号，最高人民法院知识产权审判庭，

In order to hear correctly cases of civil monopoly disputes, to prevent monopolistic conduct, to protect
fair market competition, and to safeguard the interests of consumers and social public interests, the
Supreme People’s Court has formulated the Rules on Certain Issues relating to Application of Laws for
Hearing Cases of Civil Monopoly Disputes (Draft for Comments) in accordance with the Anti-Monopoly
Law of the People’s Republic of China and other applicable laws and regulations. The Draft Rules (for
Comments) have 20 articles in total and set forth Rules for jurisdiction, parties to the litigation and rules
of litigation, evidence and burden of proof, civil liability, statute of limitation and other related issues.
The Draft Rules are now promulgated for public comments and any suggestions and comments are
welcome. Please submit your suggestions and comments by June 1, 2011.
You are welcome to submit your comments either on-line or by sending written documents. Please state
the reasons and basis of your comments for our better understanding and consideration of your suggestion.
