中文摘要 随着社会主义法治进程的深入，法治国家要求高等学校走出法治 的真空，对高校来说这是被迫的选择，同时又应是积极主动介入的过 程。典型案例表明，学生管理是高校法治薄弱的突出领域。因此，高校 学生管理法治化成为该项研究的对象。 本研究是规范研究，主要采用文献分析法和比较研究法，并结合 典型案例进行实践研究。在认识论上，坚持理性与有限理性相结合。 论文体系分为引言、正文、结语三部分。论文主体分为三部分:第一 部分，分析高校学生管理法治化内涵，第二部分，分析高校学生管理 法治现状，第三部分，进行高校学生管理法治化探索。 本研究认为，高校学生管理法治化是高校管理实现法治的过程。 它是指高校学生管理按照法治原则，实现学生管理理念从义务本位向 权利本位转变，学生管理目标从效率稳定向效益创新转变，学生管理 依据从 “管理法”向 “控权法”转变，学生管理职能从控制向服务转 变的过程。通过高校的法治精神、规则和行为方式，体现高校制度文 明。高校学生管理法治化的重要意义在于，高校法治是高校自治的根 本促进和保障，是高校更好地服务社会、生产知识和培养具有法治素 养的公民的体现。 关键词:高等学校 学生管理 法治 Abstract Withthepromotionoflawgoverning,thecountrygovernedbylaw requiresuniversitiestogooutofthevacuumoflawgoverning.Thisisa choiceforcedtouniversity,atthesametimeitshouldbeacoursethat universitiesshouldactivelytakepartin.Typicalcasesindicatethatstudent administrationinuniversityisstillafieldruledbymen.Therefore,the realizationofstudentadministrationruledbylawinuniversityischosen tobethetargetoftheresearch Asastandardstudywhichfollowsthelogicalwayofthinkingof theproblemraising-analyzing-solving,combiningthepracticeresearch oftypicalcase,theresearchprimarilyusesthemethodsofliteraturesearch andcomparativeresearch.Epistemologically,thestudystickstothe combinationofreasonandreasonlimited.
