毕 业 论 文 （ 2015 届） 题 目我国小产权房法律问题探究 学 院 政法学院 专 业 法学 年 级 2011级 学生学号 12011244535 学生姓名 张野 指导教师 段向坤 讲师 2014年4月28日 我国小产权房法律问题研究 摘要 小产权房的叫法由来已久，但是实际上我们常说的小产权房其实并不是一个法律上的概念，而是一个人们通常用于区分在国有土地上建立的房屋和在集体土地上建立的房屋的描述性词语。在理论上讲，小产权房应当是农村集体土地上建造，归农村集体所有，不允许私自买卖。然而，尽管现有法律政策禁止小产权房入市流转，但是小产权房不仅没有因政策严令禁止退出房地产市场，反而因其价格优势、我国住房体质不甚完善、城市化进程加快，住房需求量猛增而有愈演愈烈的趋势。本论文试图通过小产权房存在的种种问题提出小产权房，分析出小产权房产生的原因、现存的法律法规的界定及现存的问题问题，并分析当前小产权房所存在的困境，最后提出解决小产权房问题的若干意见及建议。 关键词：小产权房,物权,集体土地制度 Our Country Houses With Limited Property Rights Research Legal Issues Abstract Houses with limited property name for a long time, but in fact, we often say that small property is actually not a legal concept, but a people often used to distinguish between the state-owned land to build houses and built on collective land Housing descriptive words. In theory, small property should be built on rural collective land owned by rural collectives, do not allow unauthorized trading. However, despite the existing laws and policies prohibiting small property market turnover, however small property not only failed because of policy strictly prohibits exit the real estate market, but because of the price advantage, not perfect physique of housing, urbanization, housing demand is fierce growth and has intensified the trend. This paper attempts to make small property by the presence of small property problems, analyze the reasons for the small property estate of Health, the existing laws and regulations to define existing problems and issues, and to analyze the current plight of small property existed, Finally several comments and suggestions to solve the problem of houses with limited property.
