本科毕业设计（论文） 3D打印技术引发的知识产权新问题研究 3D printing technology raised new questions of intellectual property 致 谢 岁月依稀去年时，只叹时光逝在选题及研究过程中的悉心指导。多次询问研究进程，并为我指点迷津，帮助我开拓研究思路，精心点拨、热忱鼓励。余丹 2013年5月21日3D打印技术引发的知识产权新问题研究 摘要：本文主要探讨3D打印技术对于有可能侵犯的知识产权的问题。深入分析了3D打印技术在如何有效规避侵权问题发生的同时，最大程度的保护权利人的合理利益。找到两者的相互平衡点，尽可能的使其综合利益达到最大化。在保护权利人权益的同时也要防止新技术在原先的知识产权制度下发展过程中被限制，从而促进新的技术更好更快更合理的发展。 为解决3D技术可能引发的知识产权新的问题，通过探讨来避免侵权行为的发生。对比借鉴国外有关该方面的先进立法与实践，与我国现有法律相结合，从而改进目前我国3D打印技术相关知识产权法律的欠缺局面，从技术方面、法律方面和如何合理规避方面提出建议，来完善相关的法律体系。 关键词：3D打印；特点；版权；专利；建议 中图分类号：D923.41  3D printing technology raised new questions of intellectual property Abstract: This thesis mainly discusses the problems of the possibility of infringement of intellectual property rights by the 3D print technology, and also deeply analyzes how the 3D print technology protects the interests and rights of the obligee to the maximum extent without causing any infringement. We hope to find the balance point between them so as to achieve the comprehensive benefit maximization. Also, besides protecting the rights of the obligee, we need to prevent the limitation of the development of the new technology in the original intellectual property system, so as to promote the development of the new technology in a better way. In order to solve the problems of the intellectual property rights caused by the 3D print technology, and to avoid the infringement of intellectual property rights, we need to learn the advanced legislation and practice in foreign countries combined with our existing laws, so as to improve the lawless situation of intellectual property of the 3D print technology, to put forward some suggestions in the aspects of technology, law, and how to avoid infringement, and to eventually perfect the relevant legal system.
