论刑事附带民事诉讼中的精神损害赔偿问题研究 摘 要:精神损害赔偿在民事领域已趋成熟，但在刑事领域精神损害赔偿一直被拒之门外。我国现行刑事法律对刑事附带民事诉讼中的精神损害赔偿问题予以回避，而相关司法解释又做出了禁止性规定，现行司法解释排除精神损害赔偿超出了司法解释的权限，有违法理，也破坏了法律的统一性，导致了法律间的矛盾与冲突，使被害人的合法权益不能得到切实有效的保护。本文对现行刑事附带民事诉讼中精神损害赔偿问题的立法现状及弊端进行分析，提出确立刑事附带民事诉讼精神损害赔偿的意义及可行性，并对完善此项制度提出相关的建议。 关键词：刑事附带民事诉讼 精神损害赔偿 弊端及建议 Criminal incidental civil lawsuit of compensation for spiritual in damage Abstract：Spiritual damage compensation in civil field already hasten is mature, but in the realm of spiritual damage compensation has been shut sb. Key words： Incidental civil to criminal Compensation for mental damage Problems and suggestions 1 刑事附带民事诉讼精神损害赔偿的立法现状及弊端 刑事附带民事诉讼是指在刑事诉讼的过程中，对被告人犯罪行为造成的损害，被害人、被害人的近亲属、检查机关向被告人或其他负有民事赔偿义务的人提起的损害赔偿和返还财产的诉讼活动。刑事诉讼与附带民事诉讼是同源（共同的犯罪行为引起）却不同质（刑事诉讼与附带民事诉讼性质不同）的。刑事诉讼目的在于公法上的惩罚犯罪，附带民事诉讼在于私法上赔偿被害人的损失，二者所要达到的目的其实是不同的，二者存在一定联系但不能相互取代。 刑事附带民事诉讼精神损害赔偿的立法现状 对精神损害赔偿的确立要追溯到1987年1月1日实施的《民法通则》，该通则首次确立了精神损害赔偿制度，但在其条文中并无 “精神损害”的概念，只是在第120条规定:“公民的姓名权、肖像权、名誉权、荣誉权受侵害的，有权要求停止侵害、恢复名誉、消除影响、赔礼道歉，并可以要求赔偿损失。”由于侵害姓名权、肖像权、名誉权、荣誉权的行为在通常情况下不会导致直接的财产损失，因此第120条规定的“赔偿损失”被理解为对精神损失的赔偿的最早规定。随着法律制度的逐渐完善，在 2001年3月10
