中文提要  宽严相济刑事政策与刑事检察工作  宽严相济刑事政策与刑事检察工作 中文提要 宽严相济刑事政策是我们党和国家的基本刑事政策，是构建社会主义和谐社会背 景下司法理念的重塑，检察机关作为司法机关，在贯彻落实宽严相济刑事政策方面扮 演了不可或缺的角色。 本文立足检察工作视角，充分运用现有的司法资源，在对宽严相济刑事政策的基 本蕴含作出阐述的前提下，结合检察工作实践，认真分析了当前影响和制约宽严相济 刑事政策作用发挥的因素，力图通过对我国现有立法体系、司法保障机制、监督制约 机制的完善，更好地推进宽严相济刑事政策的适用。 全文共分为三大部分：第一部分，是对宽严相济刑事政策相关理论进行必要的界 定；第二部分是在宽严相济刑事政策视野中对刑事检察运行实践及原因分析;三是针 对现阶段刑事检察运行中出现的一些问题，所提出的对检察机关更好地适用宽严相济 刑事政策一些构想。提出了完善宽严相济刑事政策相适应的立法体系，贯彻宽严相济 刑事政策的司法保障机制等对策建议。 关键词：宽严相济；刑事政策；检察工作  作  者：陈  杰  II  指导教师：刘  文 宽严相济刑事政策与刑事检察工作  中文提要  thelenientandseverecriminalpolicyandCriminal prosecutions Abstract TheCriminalpolicyisthatourpartyandthecountrysbasiccriminal policyistobuildasocialistharmonioussocietyideaofreshapingthe context of judicial, prosecutorial authorities, as the judiciary, in implementingtheModerateCriminalpolicyhasplayedanindispensable role.
