钟小凯 中国法制史专题课程论文 联系方式南昌）北京） EMAIL：kai81@126.com 裁判语言修辞的司法功能研究 －－“母在与兄弟有分”判之分析 钟小凯 摘要：裁判语言修辞是中国司法的传统。通过对《名公书判清明集》卷之九户婚门违法交易十二书判之一“母在与兄弟有分”判的分析，我们发现裁判语言修辞运用的目的是为了使裁判具有社会可接受性，追求的是实质合理性的裁判结果，并具有现场宣教的浓郁风格。近代以来这种司法传统一直受到漠视甚至被彻底否定，但随着当代对理性主义的反思，裁判语言修辞对裁判可接受性的强化和对判决正当性构成的强化等司法功能得到重新认识，并在法治语境下得以复兴。在司法民主化日益凸显的今天，我们要充分发挥裁判语言修辞的司法功能。一方面，我们应恰当运用裁判语言修辞，通过裁判语言修辞达到裁判的社会可接受性的目的，使裁判获得基于共识的合理。另一方面，我们必须对修辞滥用进行规制，保证法律秩序内的正当，使裁判语言修辞在司法判决书中充分发挥合理性说服的作用，又不对现行法律秩序造成消解。 关键词：裁判语言修辞 司法功能 社会可接受性 Research on judicial function of judgment language rhetoric ---Analysis of the case “Divide property with brothers while mother’s alive” Summary: Judgment language rhetoric is the traditional in Chinese judicial sector. Through research on the Households and Marriage case “Divide property with brothers while mother抯 alive?in 揟he Enlightened Judgmental s Ching-ming Chi? we found the purpose of using judgment language rhetoric is to make judgment accepted by society, ait’s aiming to realize reasonable judgment and is has a lot of characteristics of on-site mission. This kind of rhetoric has been ignored and even denied since modern times. But with moderation on rationalism, people have new understanding on judicial functions of judgment language rhetoric such as strengthening acceptability of judgment and strengthening legitimacy of judgment, and it’s revitalized under rule of law. While the judiciary in China is more and more democratic, we should make full use of the judicial functions of judgment language rhetoric. On one hand, we should use judgment language rhetoric properly, and make the judgment accepted by society through judgment language rhetoric, therefore make the judgment reasonable on a extensive consensus base. On the other hand, we must prevent the abuse of rhetoric, ensure its legitimacy in legal order, and realize its function of rational persuasion without breaking its legal order.
