摘 要 题。 第三章论述了农村宅基地使用权流转的法律问题。从广义上讲，宅基地使用权属于 集体建设用地使用权的一种，但是《物权法》将宅基地使用权单列出来作为一种独立的 用益物权。本章在对宅基地使用权流转的现行法律规定及流转现状进行分析的基础上， 提出了宅基地使用权流转的原则和完善对策。宅基地使用权的流转要适应中国市场经济 的发展，汲取司法实务的相关经验，并应该建立与完善宅基地使用权流转的配套措施。 第四章论述了集体建设用地使用权流转的法律问题。除农村宅基地以外，集体建设 用地主要包括乡镇企业用地和乡镇公共设施及公益事业用地。现实中集体建设用地使用 权流转的大量存在使得法律处于一个非常尴尬的境地，也正由于缺乏法律的规制，集体 建设用地使用权的流转存在诸多问题。本章通过对集体建设用地使用权流转的可行性与 流转意义进行分析，提出了完善集体建设用地使用权流转相关制度的对策以及立法建 议。 关键词 土地承包经营权 宅基地使用权 集体建设用地使用权 流转 法律问题 II Abstract Abstract “Land is an old topic, but also an eternal topic.
