大学生法律人格的培育研究 Ⅰ 摘要 当代的大学生已不同于过去以往的大学生，他们大都由 80 后、90 后组成，体现 着新时代的特征。这一代大学生思想开放，独立个性，情感丰富，行为多样，处理人 际关系也透着一种“新”。但是，他们自我意识较强，易冲动，认知能力较高，但行 为不符，尚未形成稳定的人格，尤其体现在法律人格方面，他们也懂得一部分法律知 识，但在运用中达不到知行统一的境界，因此表现出法律人格缺失的现状。法律人格 作为人格范畴之一，其形成是长期的且一旦形成具有稳定性不易改变。本文针对当代 大学生的法律人格现状，在国内外研究的基础上，分析大学生法律人格缺失的原因， 同时提出不同方面的对策来完善大学生的法律人格。本文还做了问卷调查，通过问卷 调查得出的结论更能清晰地表现出当代大学生法律人格的缺陷，进而对症下药，探索 出治疗“此病”的良方。总而言之，时代需求大学生法律人格的形成，国家、社会、 学校、家庭等各个方面都应该做好本职工作，为大学生法律人格的形成创造一个良好 的环境。 关键词：大学生；法律人格；培育研究 万方数据 Abstract Ⅱ Abstract The contemporary university student has been different with the past former university students, who mostly after 80, 90 composes, manifesting the new times characteristic. This generation of university student thought has the characteristic of opening, independent individuality, rich emotion, diverse behavior, and processing interpersonal relationship is also passing one kind “newly”. But, their self-awareness is strong, easy to impulse, the cognitive capacity is higher, and the behavior does not tally, not yet forms the stable personality, especially manifests in the legal personality aspect, they also understand a part of legal knowledge, but cannot achieve the knowing and doing unified boundary in the utilization, therefore displays the legal personality flaw the present situation. The legal personality takes one of personality categories, which forms is long-term, and has the stability not to be easy to change. This article in view of the contemporary university student legal personality present situation, in the domestic and foreign researchs foundation, analyzing the reason of the university student legal personality flaw, proposed different angles countermeasure to consummates university student legal personality simultaneously.
