封面 摘要 近年来，中国影子银行体系的发展与其存在的风险，受到国内外学者与有关当局的高度关注。影子银行非常规的急速增长，一方面弥补了中国金融体系缺陷，推动了利率市场化，另一方面却引发了新的监管问题，冲减了总体政策的效果。因此许多相关的文献纷纷出炉，想要深入了解中国影子银行体系并提出规范办法，试图防范其所带的风险并消弥负面影响。本文希望通过对影子银行及其监管进行系统研究，考察我国当前影子银行发展现状和存在的问题，同时分析美国影子银行发展及监管体制，从中汲取有价值的参考经验，为我国影子银行监管制度的重构，提出可能的建议：合理地把握金融监管与金融创新的关系；加强对整个金融行业的审慎监管；建立各监管机构间的协调机制；完善金融业的法律建设；完善影子银行的内控机制 关键词：影子银行；金融风险；金融监管；美国 Abstract The development?and the potential risks of shadow banking in China have received high attention from worldwide scholars and relevant authorities recently. The abnormal rapid growth of shadow banks has made up the deficiency of China’s financial system and promoted the marketization of interest rates; however, it has also intrigued new supervisory problems, which diminishes the effects of the overall policy. Hence, many related documents were published to having an insight into China’s shadow banking system and giving solutions for the potential risks in the purpose of counteract its negative impacts. We hope that through a systematic research on the shadow banks and supervision. The effects of the current situation of Chinas development of the shadow banking and existing problems analyzed. At the same time, the shadow banking development and regulatory system, from learn valuable reference experience, for the reconstruction of our countrys regulation of the shadow banking system, and put forward suggestions of possible: reasonably grasp the relationship between financial innovation and financial regulation; strengthen prudential supervision and regulation of the financial sector as a whole; to establish the regulatory mechanism of inter agency coordination mechanism; perfect the legal construction of financial industry; improve the internal control mechanism?of the shadow banking.
