TextBABCDEFGHIJKPeterOrszag’sTrulyBadMedicalMalpracticePrescriptionJoanneDoroshowToday’sNewYorkTimescarriesacolumnbyrecently-resignedbudgetdirectorPeterOrszag,whichbeginswithOrszagcomplainingthatthehealthinsurancereformbilldidnotdoenoughtofederally“reform”statemedicalmalpracticelaws.HearguesthatCongressshould“shieldfrommalpracticeliabilityanydoctorswhofollowedevidence-basedguidelinesintreatingtheirpatients”and“providesafeharborfordoctorswhofollowevidence-basedguidelines.”Hesays,“Anyonewhocoulddemonstratethathehasfollowedtherecommendedcoursefortreatingaspecificillnessorconditioncouldnotbeheldliable.”Thisisahorrendousidea.Clinicalpracticeguidelinesshouldneverbethelegalbasisfordeterminingwhetherornotpatientharmwastheresultofnegligence.Andallowinguseofguidelinesonlybyaphysicianorfacilitytodefenditselfagainstamedicalmalpracticeclaimandnotbyaninjuredpatienttoshownegligenceiswithoutanyjustificationandisfundamentallyunfair.Thereisalreadyageneralrecognitionthatconflictofinterestandspecialtybiasareongoingproblemsinthedevelopmentofclinicalpracticeguidelines.Ifmedicalandspecialtysocietiesareallowedtoparticipateinwritingguidelinestheyknowwillbeexculpatoryfortheirmembers,conflictsofinterestandbiaswillescalate.Forexample,specialtysocieties,liketheAmericanCollegeofObstetriciansandGynecologists(ACOG),havebeenaggressiveleadersinthemedicallobbies’pushforliabilitylimitsinthelastfewyearsandremaincommittedtothatgoal.ItwouldbefundamentallyunjustforpatientstohavetheircasesjudgedbyliabilitystandardschosenbyACOGforthepurposeofexculpatingfellowobstetricians.Buttherealityisthatnomatterwhowritesthem,itisimpossibletodevelopsingleauthoritativeguidelinesforeverymedicalcondition,letalonetotrustanyentitytosuddenlybecomethesolearbiterofacceptablemedicalpractice.Itisestimatedthatmorethan1400setsofclinicalpracticeguidelinesexisttoday.Whilesomestandards,suchasthoseinanesthesia,areclearandeasilycompliedwith,others,suchasinobstetricalcases,arecomplicatedandcanbecontradictory.Moreover,astheyarewrittenfor“a
