iSinoLaw Weekly 中华法律网每周更新 Volume 41, November 15–November 21, 2010 第41期,2010年11月15日- 2010年11月21日 I.???Highlights of New Laws Two Departments Jointly Issue Notice to Regulate the Administration of Housing Purchase by Foreign Institutions and Individuals In order to further regulate the administration of housing purchase by foreign institutions and individuals, the Ministry of Housing and Urban-Rural Development and the State Administration of Foreign Exchange jointly promulgated the 揘otice of the Ministry of Housing and Urban-Rural Development and the State Administration of Foreign Exchange on Further Regulating the Administration of Housing Purchase by Foreign Institutions and Individuals?(iSinolaw Reference ID: hereinafter referred to as the 揘otice? on November 4, 2010. According to the Notice, a foreign individual can only purchase one house for self occupation in China, and a foreign institution that has established branch or representative office in China can only purchase the non-residential housing needed for its office in the city of its registration, unless otherwise prescribed by laws and regulations. The Notice requires that when conducting the record filing of commercial housing presale contract and registration of housing property right for foreign individual, the competent departments of real estate in various areas shall, apart from inspecting the relevant materials and verifying the information about the housing holding of the purchasers, inspect the proof issued by the relevant authorities regarding that the foreign individual (excluding the Hong Kong, Macao or Taiwan resident or overseas Chinese) has worked in China for more than one year; the proof regarding that the Hong Kong, Macao or Taiwan resident or overseas Chinese works, studies or resides in China, and the written undertaking that the foreign individual has no other housing in China.
