论我国银行业金融监管之完善 摘 要 银行体系是一国金融系统最重要的部分，对银行进行有效监管是应对金融危机、防止国家经济发生动荡的重要措施。随着经济全球化、金融一体化时代的到来，我国混业经营步伐在加速，对我国银行金融监管体系的考验也越发严峻。我国银行金融监管对危机和新发展趋势的应对就体现在银行业金融监管体制的改革上。 本文从我国银行金融监管的现状出发，对我国银行金融监管体制的优缺点进行分析，在借鉴外国监管制度经验的同时，结合当前金融危机对银行业的影响和国际银行金融监管的发展趋势，为我国银行业金融监管的完善提出了建议。本文拟从以下四部分进行阐述： 第一部分首先分析了我国银行业金融监管的现实情况，通过分别对银行金融监管主体、监管对象、金融监管的相关立法以及我国银行业金融监管的现实成就等四个方面加以阐述，为本文后续论述奠定基础。 第二部分在我国银行业金融监管现实情况的基础上加以分析，总结出我国银行业金融监管存在的若干问题。 第三部分是对美国、日本银行业金融监管体制的分析及借鉴。在详细分析了美国和日本的银行监管主体及内容后，总结出可为我国银行业金融监管提供借鉴的几点特征。 第四部分在前三部分的基础上，加以分析概括，对我国银行业金融监管的完善提出了主体方面和内容方面的建议。 [关键词]　 银行业　金融监管　制度完善 On Chinas Banking Supervision of Perfect Abstract The banking system is the most important part of a countrys financial system, effective supervision of banks is to address the financial crisis, an important measure to prevent the national economic turmoil. With the advent of economic globalization and financial integration era, Chinas mixed operation the pace accelerated, more severe test of banking and financial regulatory system. Chinas banking and financial regulatory response to the crisis and new development trends in the banking financial regulatory reform. This article from the status quo of Chinas banking and financial regulation, to analyze the advantages and disadvantages of Chinas banking and financial regulatory system, at the same time learn from foreign experience in the regulatory system, combined with the development trend of the current financial crisis on the banking and international banking and financial regulation for the the improvement of Chinas banking regulatory recommendations. This paper described the following four parts: The first part of the realities of Chinas banking regulators, through the four aspects of the banking and financial regulatory body, subject to the regulations, the financial supervision of the relevant legislation and the reality of Chinas banking regulatory achievements to elaborate, as discussed in this article after the commencement of lay the foundation.
