浅析非婚生子女的继承权 摘要 自古以来，婚姻制度的日趋规范化及一夫一妻制度的确立，形成一段真实有效的婚姻必须具备严格的法定要件，在出于对传统婚姻道德保护考虑的同时也使合法有效婚姻关系建立的条件更加严苛；另一方面由于社会多元化的发展对人们婚育观念造成了深刻影响，这增加了婚姻关系外生育子女的机率。为了确保婚姻的神圣性，调整婚姻家庭关系的法律制度，于是根据父母之间是否存在合法有效的婚姻关系，将自然血亲的亲生子女划分为所谓“婚生子女”与“非婚生子女”。然而，随着时代的发展，人们婚育观念的变化，非婚生育子女的现象越来越多。非婚生子女的法律地位及其权益保护日益亦成为当前亲属法亲子关系立法中的一个重要问题。本文从非婚生子女的概念、法律地位、社会权益以及各种制度入手,阐述非婚生子女现状及其形成发展的原因，发现我国法律在保护非婚生子女权利上存在着诸多的问题。揭示非婚生子女保护立法的发展趋势，并分析比较当前不同国家和地区法律的有关规定，研究非婚生子女的法律保护问题。汲取先进国家的成功经验，针对我国现行非婚生子女立法的不足提出了一些构想。 关键词：非婚生子女 继承权 权利保护 合法权益 ABSTRACT Over the years, on the one hand with the increasing standardization of the institution of marriage and the establishment of monogamy, an effective marriage must have the strict statutory requirements.
