SAND PURCHASE AGREEMENT This Agreement, taking effect since the 13th day of March 2015, is entered into by and between MBEMEBE (hereinafter called “Seller) and CRSG (hereinafter called “Buyer”). WITNESSETH: WHEREAS, through friendly negotiation, Buyer desires to purchase sand from Seller for using as raw material for building the wall, and Seller wishes to sell sand to Buyer, NOW, THEREFORE, in consideration of the premises and the mutual covenants and agreements hereinafter set forth, the parties agree as follows: 1. RECTALS Unless otherwise specified, this Agreement shall remain effective for 3 months since the above mentioned Effective Date in paragraph one. Buyer shall reserve the right to extend this Agreement with the following agreed price. 2. PRICE The purchase price for the sand shall be the sum of Tshilling 60,000=(Sixty Thousand Only )/ per BEIBEN truck inclusive loading fee (It is guaranteed that the Seller should provide at least 7 labours every day), and Seller hereby acknowledges receipt thereof in full and final payment of all costs incurred and/or to be incurred. Seller shall not be entitled to increase the above price without the prior agreement of the Buyer, who observes the right to take and delivery 2-3 full trucks of sand any time within the agreement period without the interference of the Seller or the members of the Seller. 3. Termination Should the sand supplied by the Seller prove to be unqualified, the Buyer shall have the right to terminate the Agreement with the prior notice to the Seller. 4. Dispute The agreement, once signed, can certify that the whole area of sand land belongs to Seller instead of the third party. It is noted that all liabilities and cost caused by the dispute of ownership shall be assumed and borne by the Seller.
