河 南 科 技 大 学 阶 段 论 文 题目 完善我国行政听证制度之思考 姓 名 ＿＿李 建 涛＿＿ 院 系 ＿＿法 学 院＿＿ 专 业 ＿＿法 学＿＿ 指导教师 ＿＿张 冲＿＿ 2011年 6月13日 完善我国行政听证制度之思考 THOUGHTS ON PERFECTING CHINA’S ADMINISTRATIVE HEARING SYSTEM 摘 要：行政听证制度是现代民主政治和现代行政程序的重要支柱性制度，它显现的尊重民意、制约权力的正当程序理念具有普世价值，在公共治理实践中对民主决策、科学决策以及确保权力运作的公正性，发挥着巨大的作用。我国从西方引入行政听证制度后，该制度迅速进入我国立法实践，随着对其研究的不断深入，该制度必将大大地促进我国行政法学的发展。 本文首先对行政听证制度进行了较为深入的剖析；其次介绍了行政听证制度在我国的逐步发展；随后，简要介绍了外国发展较为成熟的行政听证制度，并加以分析总结，从而得出我国行政听证制度的缺陷和不足；最后，在结合我国国情的基础上，进行了发展和完善此项制度的思考。 关键词：行政听证；现状；对策 Abstract: Administrative hearing system is a modern democratic politics and an important pillar of the modern administrative procedures of the system, which show respect for public opinion, the concept of due process restrict the power of universal value, the practice of public governance in democratic decision-making, scientific decision-making and to ensure the operation of power impartiality, playing a great role. Administrative hearing from the introduction of the Western system, the system quickly into our legislative practice, with the deepening of its research, the system will greatly promotes the development of administrative law.  Firstly, the administrative hearing system for a more in-depth analysis; then introduces the administrative hearing system in the progressive development of our country; then briefly introduced the development of a more mature foreign administrative hearing system and to be analyzed and summarized to arrive at the Administrative hearing defects and deficiencies; Finally, based on the situation of China, for the development and improvement of the system.
