分类号 密级 U D C 编号 本科毕业论文(设计) 题目 论工程合同在工程建设中的作用 摘要：随着我国工程项目合同管理制的建立与实行，各工程建设单位都充分认识到合同管理对工程建设的重要意义。工程建设中的合同管理是一项融法律、经济与一体的综合性管理工作。它一方面直接记录这工程活动的点点滴滴，并一方面还间接反映了建设全过程的原始情况，是工程管理过程中不可或缺的重要依据。本文分析了工程合同管理的作用，分析了其存在的一些问题，并提出了一些相应的解决对策，希望能给工程合同案管理工作带来一定的启发。在市场经济条件下，随着社会法制建设的不断完善和社会法治意识的不断加强，“按合同办事”已成为工程建设领域公认的一中规律和要求。施工合同依据法律的约束，遵循公平交易的原则确定各方的权利和义务，对进一步规范各方建设主体的行为，维护当事人的合法权益，培养和完善建设市场将起着重要的作用。合同管理涉及到工程建设的各方面，贯穿于工程建设的全过程。针对目前建设工程合同管理中的问题，提出了若干针对性措施，为企业的可持续发展出谋划策。 关键词： 工程合同：合同管理：制度Abstract：With the establishment and implement of engineering project contract management system in our country, the construction unit are fully realized the importance of contract management of engineering construction. In the engineering construction contract management is a combines legal, economic, and an integrated management. This paper analyzes the engineering contract management, analyses the existing problems, and puts forward some corresponding countermeasures, hope to bring engineering contract case management work must be inspired. Under the condition of market economy, with the constant improvement of social legal system construction and the strengthening of social consciousness of rule of law, \according to the contract\ has become a recognized engineering construction field one rules and requirements. Construction contract according to the law, follow the principle of fair trade determine the rights and obligations of the parties, to further standardize the construction main body behavior, safeguard the legitimate rights and interests of the parties, to cultivate and improve the construction market will play an important role.
