论整形美容中的肖像权保护 中文摘要:随着整形美容行为的普及，因整形美容而引发的各类肖像权纠纷也层出不穷，而我国民法关于公民肖像权保护的规定不够明确具体，使得司法实践中因整形美容而引发的肖像权侵权疑难案例不断增多。为了使司法机关在处理该类纠纷时有明确统一的标准，更好地保护公民的肖像权，我国应尽快明确、完善民法中有关肖像权保护的规定，并针对整形美容领域的特点，建立专门的肖像权保护机制。 文章首先通过列举现实中存在的因整形美容而引发的肖像权纠纷分析整形美容中肖像权纠纷层出不穷的原因，然后通过理论分析解决这些问题的办法.并结合我国现有法律对于肖像权保护的规定及立法精神，借鉴其他国家在肖像权保护方面的立法与实践经验，在总结上述理论和司法实践的基础上，对我国民法有关肖像权保护制度的完善以及整形美容中肖像权保护机制的建立提出建议，希望有助于今后司法实践对整形美容中的肖像权问题的解决。 关键词：整形美容；肖像权；保护；完善 The Protection of the Portrait Right in the Area of Plastic Surgery Abstract:With the popularity of plastic surgery, portrait right disputes caused by various types of plastic surgery comes into sight frequently, and the civil law relating to the protection of portrait right is not clear and specific enough, consequently, knotty cases of the portrait right violations aroused by plastic surgery in judicial practice are increasing continuously. In order to have a clear uniform standards of dealing with such disputes fairly, and to protect the plastic rights of citizens better, our state should advance the civil law on the protection of plastic rights as soon as possible and establish mechanisms on plastic right protection, considering the characteristics of the field of plastic surgery. This paper begins with listing the existing portrait right dispute caused by plastic surgery and the reason why so much portrait right problems in plastic surgery, then search for how to solve these problems. combined with existing legal regulations and the spirit for the portrait right protection in China, learnt from other countries portrait right protection in legislations and practical experiences, based on the summary of the judicial theories and practices, finally makes recommendations for improving the portrait protection system of the civil law and establishing portrait right protection mechanisms, which could facilitate future judicial practice of plastic surgery in the portrait right issues.
