2013届毕业论文 题 目 论“八议”制度 _ 专业班级 09级法学1班 学 号 0921020103 学生姓名 高山 指导教师 雷琼芳 指导教师职称 讲师 学院名称 法商学院 完成日期： 2013年4月30 日 论“八议”制度 On the deliberation system 学生姓名 高山 指导教师 雷琼芳 摘 要 “八议”制度是贯穿我国古代封建社会的一个十分重要的制度，涉及社会文化，法律，阶级构成等多个方面。“八议”现于先秦时期，通说认为于曹魏时期成制，经历了魏晋南北朝时期，于隋唐发展至鼎盛时期，于清末被废除。 本文着眼于“八议”制度的产生，发展和消亡这条主线，详细介绍“八议”制度的产生背景，发展经过和消亡的原因和结果，力图让人们宏观的了解“八议”制度。本文介绍了“八议”制度的概念，“八议”的实质是我国古代为了巩固封建阶级统治而诞生的一项制度，从外部来看，这项制度将地主阶级和平民阶级鲜明的区分开来，不断地加剧了地主阶级和平民的差距，从内部来分析，“八议”制度是统治阶级内部各个势力相互妥协的结果；阐述了各个朝代“八议”制度的发展情况和影响；第三部分是对“八议”制度的历史和现实意义进行分析，分析“八议”制度对我国古代封建社会带来的积极和消极影响,如在当时的社会生产水平之下，有利于加强统治者的威信，巩固统治，同时“八议”制度加剧了社会各个阶级之间的不平等，容易导致社会矛盾激化；并且结合现实，分析“八议”制度对当今社会带来的积极影响：给人们以警示作用，时刻提醒人们要法律面前人人平等，切忌搞特权主义，这有利于我国社会主义法制建设的健康发展，保证我国立法和司法实践的顺利进行。 关键词： Abstract Deliberation system is a very important institution throughout the ancient feudal society in China, involving many aspects of the social, cultural, legal, and class composition.
