金融诈骗罪中“非法占有目的”的认定思考 摘要 改革开放以来随着我们社会主义市场经济发展的不断深入，金融领域的犯罪活动也随之增加，尤其是金融诈骗活动呈上升态势，严重危害了我国经济的健康发展以及国家和人民的财产安全。通过制定法律完善法制建设打击各类金融诈骗行为已经成为严惩和遏制此类违法犯罪行为的良方，我国刑法中对金融诈骗罪的成立以及惩处措施有着明确的规定，在司法实践中起到了理想的作用，但是我们还是看到了法律在某些细节要件中的规定仍然存在着改进的地方，本文将以金融诈骗中的主观要件“非法占有为目的”为切入口，对当前金融诈骗“非法占有目的”认定中存在的争议，实务中非法占有目的的认定方法以及结合各类典型案例谈一谈自己的见解和看法。 本文包括引言、正文、结语三个部分，正文由三章组成。主要内容如下： 第一章着重阐述金融诈骗罪中非法占有目的的立法现状以及存在的学术争议，阐明当下的学术通说并谈一谈自己的看法。 第二章重点阐述实务中“非法占有为目的”的认定方法。 第三章主要通过结合各类典型案例，透过实际情况，表明自己的观点，并提出几点看法为立法者建言。 [关键词] 金融诈骗罪 非法占有目的 认定 The thinking of the identification for the purpose of illegal possession in The Crime of Financial fraud Abstract With the deepening progress of reform and opening up in Chinas socialist market economy, the number of criminal activities in the financial area has been on a rise, among which the financial fraud is increasing seriously. These criminal activities have done great harm to the healthy development of Chinas economy as well as property security of both the country and the people. Improving the legal system to enact laws to combat all types of financial fraud has become the best way to put severely punish in such criminals and deter further criminal acts. As we can see, Chinas criminal law has claimed a clear statement on the definition and punishment measures on financial fraud, and played an important role in judicial practice, however, the Criminal law in some details still need further improvement. Therefore, this paper will be built from the perspective of the subjective element of such crime, which is the purpose of illegal possession, by discussing the controversies the authorization methods in practice, at the same time combining various types of typical cases to make a point of my own.
