The Mental Health of Crime Victims:Impact of Legal Intervention1犯罪受害者的心理健康:法律Intervention1的影响In the aftermath of crime, victims must decide whether to seek justice. An encounter with the legalsystem offers major potential benefits to crime victims, but also exposes them to significant risks.Victims who file civil or criminal complaints are subject to the rules and procedures of a complex legalsystem, where their mental health and safety may be of marginal concern, and where the potential forretraumatization may be high. This paper reviews the social and psychological barriers that discouragevictim participation in the legal system, and existing studies that document the impact of participationon victims’ mental health. Physical violenceand intimidation are not allowed in court, whereas aggressiveargument, selective presentation of the facts, and psychologicalattack are permitted, with the presumption thatthis ritualized, hostile encounter offers the best method ofarriving at the truth.Constitutional limits on this form of conflict are designedto protect criminal defendants from the superiorpower of the state, but not to protect individual citizensfrom one another. The law is technically blind to any disparitiesin power based on age, race, gender, social status,or wealth between accuser and accused.
