中文摘要 近年来，随着社会的不断进步、经济的不断发展，在效率、自由、公平同为我们共同追求的价值取向的当今社会，格式合同已经成为当今交易中一种重要的交易方式。而随着格式合同出现格式条款广泛地存在我们现实生活中的方方面面。然而在格式条款的订立过程中，格式条款接受者的合法权益却经常受到侵犯。造成该现象的主要原因是目前我国规制格式条款立法滞后，导致多数消费者的合法权益得不到充分的保护。本文首先提出对格式条款予以规制的必要性，通过分析格式条款订立过程中侵害格式条款接受者合法权益的现象，指出目前我国对格式条款规制的诸多不足。针对这些不足，提出完善的格式条款规制的具体应该从立法、司法等方面加以规制，建立一套完善的格式条款法律规制制度，以期更加有效的保障格式条款接受者的合法权益，并促使我国经济持续、繁荣、健康的发展。 关键字：格式条款；免责条款；缺陷；立法规制； Abstract In recent years, with the development of society and the continuous development of the economy, in efficiency, free, fair and common pursuit for us the value orientation of modern society, format contract has become one of the most important current trading transactions. And with the format contract appear format clauses widespread aspect of our real life. However, in the process of standard terms, concluded the lawful rights and interests of the receiver format terms but often infringed. Cause this phenomenon is the main reason of the current regulation format terms legislation lags behind, resulting in most consumers legal rights and interests get sufficient protection. This paper first puts forward the necessity of adhesion contracts concluded, by analyzing the process of standard terms violation format terms the legitimate rights and interests of the receivers, and points out that at present our country to the phenomenon of standard terms regulation has some shortcomings. According to these disadvantages, puts forward the perfect format terms from the concrete should regulate legislative, judicial aspect regulation, set up a set of perfect format clauses legal regulating system, in order to more effective safeguard the lawful rights and interests of the receiver format clauses in China, and promote sustainable economic and prosperous and healthy development.
