东北农业大学学士学位论文 学号：960130707014 论行政不作为的责任及其法律救济 Concerning on responsibility of administrative omission and its Legal Remedy 学生姓名：胡庆坤 指导老师：王卫国 所在院系： 网络学院 所学专业： 法学 研究方向： 东 北 农 业 大 学 中国·哈尔滨 年 月 摘 要 作为行政行为的一种，行政不作为广泛存在于社会生活的各个方面，它破坏了人民对政府的信任，侵害了国家和人民的利益，有着巨大的危害。对行政不作为进行研究，正确界定行政不作为，准确认定其责任，对其进行相应的法律救济，不仅是促进行政主体依法行政的需要，也是保障相对人合法权益的需要，更是建设社会主义民主、法治国家的需要。 日前我国的行政法学界对行政不作为的研究探讨不够，司法实践中也存在着许多模糊的认识。因此我们有必要对其进行一番探讨。本文即以行政不作为为研究对象，借鉴有关刑法和民法的研究成果以及其他国家相对成熟的不作为理论，对行政不作为进行深入分析研究，以达到深化行政不作为理论和指导相关实践的目的。 关键词：行政不作为 责任 救济 Abstract As one kind of administrative action, administrative omission exists everywhere in our society. It damages citizens confidence in our government; it damages the rights of citizens and the interests of our country. Administrative omission can do tremendous harm. The study of administrative omission in order to make sure its definition, to determine its responsibility and to provide correspond remedy. It is not only a demand to promote administrative action pursuant to law, but also needs to protect private partys legitimate rights and benefits, and to construct democratic country ruled by law. However, currently the study on this area is far from enough, and there is much chaotic recognition in judicial practice. We have necessary to discuss this topic. This essay analyzes and studies administrative omission combining with relative theory of criminal law and civil law, using relative perfect omission theory of other countries for references, in order to achieve the goals of improve the theory of administrative omission and direct the relative practice.
