土地產权制度改革的突破土地发展权.doc

摘 要 当前，我国土地产权制度存在众多不足，土地发展权空缺成为突出问题之一。研究土地发展权，有利于填补我国法律空白，完善我国土地权利体系，保护耕地资源，维护生态环境，促进社会公平，加速农村土地改革，实现可持续发展，解决土地管理难题和现实问题，对建设社会主义法制国家和构建和谐社会都具有重要的意义。本文基于对我国土地产权制度改革的综合分析，从理论上对创设土地发展权做了详细介绍，从而为弥补了当前土地产权制度的不足提供帮助。具体如下： 首先简要介绍了土地产权以及土地产权制度，并重点对土地发展权的内涵、特征、归属进行了理论综述，同时也对土地发展权在土地产权制度中的地位做了分析；其次，对土地产权制度改革的历程、现状和创新方向做了探讨，阐明土地发展权是土地产权的突破；接下来，从经济、社会和制度的角度对土地发展权设立的必要性和可行性做了研究；然后，并运用动态分析法对我国的土地发展权创设的一系列理论内容加以阐明；最后，借鉴国外土地发展权的运行模式，提出我国土地发展权的运行模型：即结合我国的政府层级安排，土地发展权按照一定机制分别在宏观、中观和微观三个层次进行配置和流转。 关键词：土地产权制度；土地产权；土地发展权 Abstract Present, Chinas land property rights system there are many less than the vacancy of land development rights is the most prominent.
