摘 要 死刑是最为严酷的刑罚，它剥夺人的生命，剥夺人被法律所赋予的某些权利。死刑在刑法发展史上经历了一个兴起、泛滥与没落的过程。奴隶社会初期，死刑在刑罚中所占比重较小，延至奴隶社会中后期和封建社会，死刑进入鼎盛时期，各国均建立起了以死刑为核心的刑罚体系。伴随着人类文明的不断发展，人们开始对死刑提出质疑，贝卡利亚在著作《论犯罪与刑罚》中第一次提出废除死刑的主张，接踵而至的便是世界各个国家和人民对于死刑存废的争论。死刑存废问题并非能够一蹴而就，它是一场持久的，前进的，发展的战争。依旧世界总体趋势，了解总结死刑存和死刑废的各种理论观点。由于废除死刑必须具备一定的社会物质、观念条件，而我国现阶段的政治经济与人文背景，完全废除死刑的条件并不成熟。我国的死刑废除必须走一条由严格限制死刑到完全废除死刑的理性之路。 全文共分为六个部分。 第一部分，死刑的概述。死刑，也称为极刑、处决，世界上最古老的刑罚之一，指行刑者基于法律所赋予的权力，结束一个犯人的生命。 第二部分，废除死刑的各种学说。 第三部分，死刑制度在中国的现状。我国对死刑在理论上的共识是减少死刑而非废除死刑。保留死刑而坚持少杀、慎杀，反对多杀、错杀，是我国的基本态度。 第四部分，现阶段中国实行死刑的必要性。 第五部分，我国应严格限制死刑的适用。 第六部分，对中国死刑制度的展望。 关键词：死刑；死刑存废；刑法 Abstract The death penalty is the most severe punishment, it not only depriving people of life, and depriving people given by law of certain rights.
