Abandonment by the system The juvenile system is abandoning delinquents, only responding to them when they commit serious and heinous crimes. According to Humes, sixteen percent of juveniles arrested for the first time, commit at least four more crimes. Juveniles are given probation officers who are too busy to follow up and see if the juveniles are on the right track. Therefore, they continue a life on the street and involved in crime. The system focuses on the more dangerous children, letting the at risk children slide by growing older, only to be tried as an adult when they are caught committing a crime. Is there protection from the system? With simple slaps on wrists, the juvenile system is programming children to believe that it is ok to break the law. For example: “A thirteen year old boy assaults another boy with a baseball bat, arrested for assault with a deadly weapon” (Humes). The punishment: unsupervised probation. The system is not protecting the innocent citizens from dangerous juveniles, nor are they stopping criminal activity early to protect children from possible delinquent activity. Juvenile or Adult? When juveniles are brought to court, a fitness hearing is used in determining whether the child will be tried as a juvenile or adult. Five factors: past criminal record, time left to rehabilitate, results of past attempts at rehabilitation, criminal sophistication, and gravity of the crime ( Humes).
