Retrospect of Enactment of the Labor Law of Our Country Li Jianfei The making process of the Labor Law of our country The Labor Law of our country went through two drafting periods, which is unusual in the legislative history of our country. In December, 1978, Comrade Deng Xiaoping delivered a speech at the Working Conference of the Central Government, which was entitled Emancipating the Mind, Seeking Truth from the Facts, and Looking Ahead in Unity. In his speech, he pointed out that “the Factory Law, the People’s Commune Law, the Forestry Law, the Grassland Law, the Environmental Protection Law, the Labor Law, the Foreign Investment Law and the like should be enacted as soon as possible.” The former National Labor Bureau transmitted the spirit of the 3rd Plenary Session of the 11th Central Committee of Chinese Communist Party, and then, it decided to organize relevant personnel to draft the Labor Law. In January, 1979, the leading group for drafting the Labor Law was established, which invited the competent people, experts and scholars from the National Federation of Trade Unions, the Ministry of Agriculture, Beijing University, Beijing Institute of Economics, China University of Political Science and Law, the Institute of Law of Chinese Academy of Social Sciences, and so on to participate in the discussion and the drafting work. In July, 1979, the first draft of the Labor Law (Draft) was completed. By March, 1983, the 17th draft was formulated, which was discussed and approved in principle by the Standing Committee of the State Council on March 29, 1983. In July, 1983, the 18th draft was submitted as the draft for examination and approval to the Standing Committee of the National People’s Congress (NPC). This draft was revised in accordance with the opinions of the relevant leaders of the Commission of Legislative Affairs of the Standing Committee of the NPC.
