ACT OF THE REPUBLIC OF INDONESIA NUMBER 13 YEAR 2003 CONCERNING MANPOWER CHAPTER II : STATUTORY BASIS, BASIC PRINCIPLES AND OBJECTIVES ARTICLE 4 Manpower development aims at: Empowering and making efficient use of manpower optimally and humanely; Creating equal opportunity and providing manpower (supply of manpower) that suits the need of national and provincial/ municipal developments; Providing protection to manpower for the realization of welfare; and Improving the welfare of manpower and their family. CHAPTER III : EQUAL OPPORTUNITIES ARTICLE 5 Any manpower shall have the same opportunity to get a job without discrimination. ARTICLE 6 Every worker/ laborer has the right to receive equal treatment without discrimination from their employer. CHAPTER V: JOB TRAINING ARTICLE 9 Job training is provided and directed to instill, enhance, and develop job competence in order to improve ability, productivity and welfare. (as manpower right) CHAPTER IX : EMPLOYMENT RELATIONS ARTICLE 50 Employment relation exists because of the existence of a working agreement between the entrepreneur and the worker/ laborer. ARTICLE 51 (1) Working agreements can be made either orally or in writing. (2) Working agreements that specify requirements in writing shall be carried out in accordance with valid legislation. ARTICLE 52 (1) A working agreement shall be made based on: a. The agreement of the parties; b. The capability or competence to take legal actions; c. The availability/existence of the job which the parties have agreed about; d. The notion that the job which the parties have agreed about is not against public order, morality and what is prescribed in the prevailing laws and regulations. (2) If a working agreement, which has been made by the parties, turns out to be against what is prescribed under point a and point b of subsection (1), the agreement may be abolished/cancelled.
