英文摘要 论保安处分制度在我国的建立 Research on System Establishment of Security Measures in Our Country ---From Abolition of Undergo Education through Labour Abstract In the contemporary healthy legal institution society, there are some people who is not yet constitute a crime but break the law seriously or for many times, they have great personal risk. In order to prevent crime and defense the society, it is necessary to take certain precautions. Preventive measure in western countries is in the form of security measures, and it has been incorporated into the legal track. But in our country, what used to be a precaution is the undergo education through labour, which is stipulated and executed directly by the administrative organizations. It has serious defects in legitimacy, legal process, human rights protection, and whether there is a special supervision organs. Therefore through researching and summarizing the experience and lessons from the undergo education through labour and learn from security measures is an innovative path to establish crime prevention system in our country. This paper first summarizes the problems existing in the undergo education through labour in order to prevent follow the same old disastrous road. Making a deep analysis and research in the nature, the system for foundation, the principles, the legislative mode and legal supervision of security measures for a system construction. In the process of research through reading books at home and abroad, combining the methods such as empirical analysis, I try to summarize the defects of undergo education through labor and complete coming up with preliminary ideas of establishing security measures system in our country.
