Abstract The main task of Criminal Litigation Law is sure to search the crime timely and accurately, which applies the laws correctly, publishes the offenders and guarants the innocence people without criminal pursuit. However, the supplementary investigation among them is one of a remedy messure for investigation, which is a litigation activity of the Police and Peoples Procuratorate who are engaged in the re-investigation and based on the origial investigation, when they have not enough evidence or the case is unclear. Meanwhile, Supplementary Investigation can be sure that the Police, the People’s Procuratorate and the Court can use their different rights. Not it only overcome the subjective one-sidedness, reinforcing mutual supervision, avoiding abuse of power, guaranting the right of suspected person and the defendant, but also guarant the organs can carry out the law, expose crime, publish crime timely and accurantely. Hence, it can implement the litigation principle of division of responsibililies, co-ordination, mutual constaints among the Police, the Court and the People’s Procuratorate. In our country ‘Criminal Litigation Law’ formulates that the supplementary investigation should be finished within one month. On this basis, it is also limited with times, which makes the supplementary more standard but it exists some deficiency during the practical judicature. This paper introduces the Supplementary Investigation and explains the different function on the aspects of investigating fact, using appropriate using law, protecting suspected people and the legal right of the defendant. Moreover, this
