解读物权法:物权法明确保护“阳光权”
将于2017年10月1日起施行的物权法,对相邻建筑物的通风、采光和日照作出明确规定,为公民维护“阳光权”提供了法律依据。
物权法规定:“建造建筑物,不得违反国家有关工程建设标准,妨碍相邻建筑物的通风、采光和日照。”
近年来,随着城市建设速度加快,住宅建设用地供应趋紧,加之一些城市在对新建住宅楼规划审批环节中存在漏洞,有些开发商违规施工,超规划建设,导致新建住宅楼层数过高,密度过大;有些人甚至为求便利,私搭乱建,影响相邻建筑的通风、采光,使基于“阳光权”引发的纠纷日益增多。物权法规定,不动产的相邻权利人应当按照有利生产、方便生活、团结互助、公平合理的原则,正确处理相邻关系。法律、法规对处理相邻关系有规定的,依照其规定;法律、法规没有规定的,可以按照当地习惯。
法律专家称,所谓相邻关系,简言之就是不动产的相邻各方因行使所有权或使用权而发生的权利义务关系。
据民法专家王利明介绍,物权法明确了物的权属,侵权责任法则将明确权属受到侵害该怎么办。全国人大常委会2017年立法计划安排的9件预备立法项目中就包括制定侵权责任法。
