2015 年6 月 《齐齐哈尔大学学报(哲学社会科学版) Joumal of Qiqihar University( Phi 50c 5ci) June , 2015 社会学法理学的三层权威 一一依法治国逻辑脉络的寻求 樊小鹏 (广西大学法学院，广西南宁 530004 ) 摘 要:以寻找依法治国背后的理论思维为目的，从社会学法理学所形成的法律社会控制力量维度进行剖析， 由浅入深依次发现三个层次，即事实压力、形式安全、价值利益的法律权威。压力社会控制、安全社会 控制、利益社会控制从三个不同的角度构建了自己的辐射域，而二点辐射重叠区正是社会学法理学所构造的社 会控制系统，三点鼎立的面状区在实质内容与形式逻辑上造就了社会工程。而此恰恰是依法治国方略在中国 从政策到具体法规的逻辑脉络。 关键词:社会控制;社会工程;利益价值;依法治国 中图分类号:D90 -05 文献标识码:A 文章编号:1008 -2638(2015)06 -0042 一 03 The Three Levels of the Authority of Sociological Jurisprudence 一一-Looking for the logic clue of rule the country by law FAN Xiao - peng (School of Law , Guangxi University , Nanning Guanxi 530004 , China) Abstract: The purpose of this essay is to discover the mode of operation of rule the country of law theory from the perspective of the social control force created by sociological jurisprudence. Gradually , this essay finds three levels of authority: reality pressure , form security and interest. 50cial control can be embodied from three different angles: social control through the pressure , social control by security and social control through protecting interests. And the overlap between these three angles is the so - called social control. 50 the overlap of the three angles of pressure , security and interest constitutes the social engineering both in substance and form of logic , namely , the logical clue of the rule the countηby law.
