民事诉讼论文：论我国民事再审制度之完善 【中文摘要】《中华人民共和国民事诉讼法修正案》对民事再审程序作出了较为详细的修改,但是其中仍存在一些不足。我们知道再审制度是中国法制制度的重要制度之一。随着改革开放的进一步深入和市场经济体制的建立和发展,新情况、新问题的不断出现,对于完善再审制度提出了更高的要求。论文的研究主题为民事再审制度的不足与完善,本文以民事诉讼的基本原理为指导,结合司法实践中出现的一些问题,从再审事由、申请再审的期限、审查方式以及再审案件的审理等方面进一步完善我国民事再审程序。并重点对再审之诉的起诉条件和再审主体问题进行分析。论文先就我国现在实施的民事审判监督程序的基本特征,以及在司法实践中所产生的种种问题作出了简要的概述。本文章可以称为静态的“作为科学的法律学”,这是从文章的性质上说的,以及文章的主要在于构建制度体系和理论体系。论文从多种视角对检察院参与民事诉讼之理念问题进行了分析和研讨。基本结论为：一方面,针对某些涉及人事或家事的民事案件,出于维护公益的考虑,法律应授予检察院民事诉讼权。在依照大陆法系模式改造我国民事诉讼当事人制度的基础上,应赋予检察院对法律所明确列举的“公益民事案件”享有一定的诉讼地位。另一方面,基于对维护市场主体意思自治的考虑,不应准许检察院对绝大多数民事案件享有民事抗诉权。唯一的例外是对存在国有资产的诉讼案件,为保护国家利益,检察院应辅助参加,以便收集有关的信息和资料。一旦发现诉讼中出现国有资产流失的情形,检察院有权依法向有关法院提起民事再审之诉或刑事附带民事之诉。 【英文摘要】The Revised Edition of the Law of Civil Lawsuits of People’s Republic of China make modifications of the retrial procedures of civil cases in detail,but there are still some deficiencies in civil retrial system.It is universally acknowledged that retrail system is one important foundation stone on the road of china抯 law. With the further deepening of reform and open-up. The establishment and development of market economics system,the bettered retrial program should be needed higher standard.The topic of this paper is deficiencies in civil retrial system and counter measures. This paper suggests that the civil cases be improved through retrial reasons, duration of retrial appeal,check methods,and trail of retrial cases on basic principles of civil lawsuts and in consideration of the problems of judicial practices. Furthermore this paper analyze and the suing essences and subjective of civil retrial.The author explains the current situation of China抯 civil trial supervision proceeding,and states the problems created in juridical practice.This paper focus on the reconstructing of civil retrial抯 institutions and jurisprudence,which can be considered as a static juridical research,rather than the flesh field study of legal developing trends.Besides,this paper states that it shoud be forbidden for procuratorial
