罗马法精神及其现代意义

摘 要 :罗马法流传至今仍不减其影响 ,在于其蕴涵的罗马法精神 ,罗马法精神主要包括自然
法精神、私法精神和理性精神 ,三者影响了现代社会中人们对法律的观点和对法律的研究方法 ,并
且激发了当代人的社会主体意识。

Abstract :Rome Law handed down up to now , whose influence is still as great as ever , lies in the
spirits of Rome law contained by it. The spirits of Rome Law mainly contain the spirit of natural law , the
spirit of private law and the spirit of the rational faculty. The three spirits have influenced people in the
modern society on the viewpoint and reseach method of laws , and aroused social subject consciousness of
the contemporary people.
