内容摘要 本文围绕我国中央与地方立法权的优化配置这一论题，运用语义分析、实证分析等 方法，对我国宪法和法律中有关中央与地方立法关系的具体规定，以及中央与地方立法 权在现实运行中的具体状况进行了研究分析。认为当前我国中央与地方立法权配置方面 的现状与存在问题主要包括：立法权高度集中于中央，表现为国家最高立法机关、最高 行政机关享有非常广泛和重要的立法权，地方立法多为中央立法的执行性立法，对中央 立法照搬照抄、机械重复现象严重；地方立法权规定模糊，易导致中央与地方各自所立 之法的冲突，由于宪法与法律未对地方立法权作明确的规范，地方立法权容易在地方私 利的驱动下，侵入中央立法权领域，导致地方法律与中央法律的冲突；中央与地方立法 权缺乏有效的监督与协调机制，包括缺乏专门、独立的监督协调机关，缺乏有效的监督 协调手段，缺乏追究立法监督主体相关法律责任的明确规定。针对上述问题，本文就如 何进一步优化配置我国中央与地方立法权提出了初浅的建议：划分中央与地方的立法 权，力求法制化、规范化，包括对地方立法权应进行明确列举，同时将立法权明确分为 中央专属立法权、中央与地方共同立法权、中央原则性立法权几大类；建立高效的监督 协调机制，由相对中立的司法机关体系来承担协调中央立法与地方立法冲突的职能，充 分启动并运用好现有的监督协调手段，并且建立健全立法权的监督责任制。 关键词：中央与地方；立法权；优化配置 1 Abstract This dissertation is discussing about the issue of the optimized arrangement of the power of legislation in central and local government in China that the author adopted the linguistic analyzing and positive analyzing methods and so on to make the analysis over the detail rules about the relationship between the central and local government according to the Constitution and laws and the current situation of the practices between the two legislated arrangements. So the author considers that the current situation and the existing problems o the legislated arrangement between the central and local governments are including the following aspects: one is that the power of legislation is centralized in the central government in a high degree which exhibits that the supreme legislated agency and the highest administrative agency had embodied the expanding and important power of legislation that show the strictly simulation and the ambiguous rules which might caused the conflicts between the central and local legislations.
