摘 要 摘 要 人是差异性与同一性的现实统一。正义归根结底是关于人的正义，人是差异 性与同一性的现实统一，因而正义是差异性正义与同一性正义的统一。差异性正 义与同一性正义的恰当作用推动了社会的不断向前进步，从这个意义上可以说， 正义本身即蕴含着效率的向度，或者说效率本身即正义的基本价值内涵之一。然 而正义与效率间的关系并非是线性的，无论是对差异性正义抑或是对同一性正义 的强调如果超过一定的限度，都可能导致一种非理想的状态，从而不利于效率的 追求，所以说正义对效率的促进作用并非是绝对的，而是存在某种限度。 当前，我国已提出建设和谐社会的伟大构想。和谐社会是一个既合乎正义要 求的社会，同时又是一个具有一定发展速度的社会，也就是说，正义与效率的统 一与协调是和谐社会的题中必有之义。本文将正义与效率之间的关系作为探讨对 象，考察正义的效率之维及其限度，应该说是具有较大的理论价值与实践价值的。 [关键词] 正义，效率，差异性正义，同一性正义 第i 页 ABSTRACT ABSTRACT Human being is the unity of difference and identity, justice is the justice of human being, the duality of human being result in the duality of justice, so justice is the unity of justice of difference and justice of identity. The development of society is promoted by the proper function of justice of difference and justice of identity, so we can say, justice involves efficiency in itself, in other words, efficiency is one of fundamental elements of justice. However, the undue attach importance to justice of difference or justice of identity can result in a unideal status, so no good to the pursuing of efficiency. For the pursuing of efficiency, the promotion produced by justice is limited. Certainly, the other connotation of justice is he restrictions of the pursuing of efficiency too. At current days, China is building up the concordant society. The concordant society is not a society of injustice nor a stagnant society, in other words, the unity of justice and efficiency is the certain claim of the concordant society.
