———关于 “活法 ”的研究①

摘要 : 法律发展的重心不在于国家的活动 ,而在于社会本身 ,必须从社会中寻找 。我们发现 ,简单陈旧的奥地
利法典在现实生活中,尤其是私法领域中,是完全被漠视的 ,代之发挥作用的是大量习惯法 。以此为起点 ,就
逐渐发展出 “活法 ”学说 。活法是和那些被法庭和其他裁判所强制实施的法律相对而言的 ,是那些支配着社会
生活本身的规则 ;活法观具有独立的价值 ,活法构成了人类社会法律秩序的基础 。从这一意义上讲 ,法社会学
必须从探察发现活法开始 。

Ab stract: Ehrlich argues again st the traditional m ethod of legal re search , wh ich regard s the statutes a s
the object of research. W e find out that the developm ent of law is not centered around national activitie s
but society itself, and therefore it can on ly be studied w ith society as a point of dep arture. The above i
deas ha s re su lted in the theory of living law wh ich is the m ain object of legal research. The article
m ain ly discu sses how he h im self com e s to know the p rogress of legal re search , and reveals to other in
ve stigators that the living law ha s an indep endent value, and it con stitute s the foundation of the legal or
der of hum an society.
