y 论船舶油污损害的国家责任 摘要 随着海上运输业的发展，因船舶油污造成的海洋污染也不断增加。当前，国际社 会普遍致力于通过建立和完善民事赔偿责任制度来解决船舶油污损害问题。笔者认 为，在船舶油污损害赔偿这一领域建立与民事责任相区别的国家责任同样重要，但国 家责任制度至今仍未引起国际社会的足够重视。 笔者从五个部分来论证这一问题。第一章从法理学的角度对国家责任和跨界损害 进行理论分析，明确了随着社会的发展，国家责任理应运用到跨界损害中。第二章从 理论和现实两方面进行论证，明确了建立船舶油污损害国家责任的必要性。第三章采 用分类的方法，分析了在各类不同的船舶油污损害情况下国家责任的运用，从而确定 了在船舶油污损害中国家责任的适用条件及免责条件。第四章结合现行的立法，对国 家责任制度的具体索赔问题进行了论述。在第五章中，从定义、基金等方面论证了如 何构建完善的船舶油污损害国家责任制度，明确了国家责任制度的发展方向。笔者期 待通过以上的分析，能够促使国际社会重视并加快国家责任制度的建立，以此保障无 辜的油污受害人得到完全的赔偿，使海洋环境污染得到控制。 关键词：船舶油污损害，赔偿机制，国家责任 论船舶油污损害的国家责任 the forthe Pollution A on State Oil Study Liability frOm DamageShips Abstract Withthe ofmaritime oil from is developmenttransport．marinepollutionships also international devotestosolvethe increasing．Atpresent，the societygenerally oil theestablishmentandthe of pollutiondamageproblemthrough improvement thecivil authorbelievesitisessentialtoestablishthestate liabilityregime．The which fromthecivil inthefieldofthemarineoil liability distinguishes liability until internationalhasnot now,the paid pollutiondamages．But society enough to attentionthestate liabilityregime。 Theauthorcomesto this fromfive one analyzequestion chapters．Chapter carriesonthetheoreticalfromthe onthestate
