英国《数字经济法案》综述 张亚菲 * 内容摘要：为了应对信息时代的挑战，促进英国经济的复苏与发展，英 国政府于2 0 0 8 年启动了“ 数字英国计划” ，随后于2 0 0 9 年 1 1 月颁布了《数字 经济法案》，从而拉开了建设“ 数字英国” 的序幕。《数字经济法案》共 4 8 条， 主要涉及网络著作权侵权的治理、增加电子出版物的公共借阅权、更改域名 注册规则、广播电视管理规则的修改，以及视频游戏的管理等问题。该法案 一经颁布，便引起英国全国范围内的巨大争议和广泛讨论，尤其是有关网络 著作权侵权的规定遭到各方的质疑。但《数字经济法案》毕竟标志着英国在 保护网络著作权、促进信息化发展的道路上迈出了积极的一步，为其他国家 发展数字经济提供了宝贵的借鉴经验。 关键词 ：英 国 ；数 字 经 济 法 案 ；网 络 著 作 权 保 护 ；网络服务提供商； 公共借阅权 Review of the UK Digital Economy Act Abstract ： For the purpose of confronting the challenges from the Information Age, as well as promoting the recovery and development of the economy, in 2 0 0 8 , the British government launched “ Digital Britain Plan” ， followed by the promulga- tion of the “ Digital Economy Act 2 0 1 0 ” in November, 200 9.
