中国的宪法惯例研究 Research on the constitution practice of China 梁卫华 Liang Wei-hua （恩平广播电视大学，广东 恩平529400） （Enping Radio ＆ Television University ，Enping Guangdong China 529400 ） ［摘要］我国是否存在宪法惯例以及有哪些宪法惯例，似乎是所谓“敏感”的重大问题。笔者认为， 科学研究无禁区，从方法论上讲，判断哪些规范属于宪法惯例，应当以彻底的辩证唯物主义为指导，实事 求是，不要回避矛盾，尤其是不能犯机械唯物主义的错误。中国宪法学研究应当更多地面对实践，只有立 足于中国的现实问题，才可能生长出有生命力的中国的宪法学理论。在认定中国是否存在宪法惯例的时候， 不能只看它有没有宪法的“名份”，而要看它对国家最基本的制度是否产生了真实、深刻的影响。本文试 从宪法惯例的概念及其特征、宪法惯例的形成及其在成文宪法国家的客观存在、宪法惯例的作用等出发， 阐述宪法惯例在中国客观存在的事实，以及确立中国宪法惯例的法律地位的必要性和重要意义。 ［关键词］宪法惯例；中国；客观存在；法律地位；意义 Abstract: whether there is constitution practice or what constitution practice there is in our country seems to be an important and “sensitive” problem. In the outhor’s opinion, there is no restricted area in science. According to methodology, judging which standards belong to constitution practice should actually base on thorough dialectical materialism, without avoiding contradiction and making mistakes of mechanical materialism. Research on the constitution of China should face the reality more. As long as we base upon the reality of China, we can make the constitution theory of China which has great vitality. When we think whether there is constitution practice in China, we can’t just see if there is a “name” of constitution, instead we should see if it will produce a true and deep effect on the most fundamental rules in our country. This paper tries to discuss the objective truth that there is constitution practice in China and the necessity and significance of establishing the legal position of the constitution practice of China.
