浙江科技学院成人高等教育学士学位论文行政授权理论与实践研究STUDY ON THE AND PRACTICE OF ADMINISTRATIVE LICENSE作 者：XXX指导老师：XXX专 业：行政管理研究方向：行政管理学实习单位：XXXXXXXXXXXXXXXXXX二O一四年*月*日行政授权理论与实践研究摘要随着经济的飞速发展以及纷繁复杂的社会现象的出现，原有行政权力的配置和分化己经不能满足公共行政管理的需要，行政授权作为一种分权制度应运而生，纵观西方各国的行政法制建设，都可见行政授权的踪影。在我国行政法理上，往往将“法律法规授权”直接等同于行政授权，而对于真正意义上的行政授权，即“行政职权转移”意义上的行政授权，未予以足够重视。事实上，“行政职权转移”意义上的行政授权广泛存在于各国的公共行政实践；虽然在行政授权上，各国的关注不多且缺少系统地研究,但均不同程度的承认其客观存在。本文从授权行政主体的理论入手，通过分析各国有关授权行政主体的理论，再结合我国授权行政主体现状中的各种不足，从而总结出我国行政授权主体所存在的一些问题，并根据这些问题提出一些个人观点，以探索出符合我国国情的授权行政主体的发展方向。关键词：行政管理 行政授权 分权制度ABSTRACTWith the rapid development of economy and the complicated social phenomenon, has the original configuration and differentiation of administrative power can not meet the need of public administration, administrative licensing as a decentralized system emerge as the times require, administrative building of the legal system in the western countries, can see the administrative authorization. In Chinas administrative jurisprudence, tend to be authorized by laws and regulations directly equivalent to the administrative licensing, and for the true meaning of the administrative licensing, namely administrative authority transfer sense of administrative license, not enough attention. In fact, the public administrative practice of administrative authority transfer sense of administrative licensing widely exists in all countries; although the administrative authorization, countries dont pay much attention and there is a lack of systematic study, but all have different levels of recognition of its objective existence.This article from the authorized administrative subject theory, through the analysis of all relevant authorized administrative subject theory, combined with our authorized administrative body the shortcomings of current, and summarizes some problems in Chinas administrative authorization subject exists, and puts forward some personal views on these problems, in order to explore the development direction of administrative author
