论文摘要 现今社会，夫妻间的家庭暴力行为已成为了婚姻生活中普遍存在的现象，也成为了 影响夫妻感情、家庭和睦比较主要的因素之一。尤其在许多落后的农村地区，主观方面 由于男尊女卑等封建传统思想根深蒂固，再加上女性在身体力量上的劣势等客观原因， 女性往往成为家庭暴力的受害者。笔者作为一名基层法庭的法官，通过平日对农村离婚 案件的审理后发现，家庭暴力已成为现今农村离婚案件中比较普遍的诉讼理由之一。但 是由于受害的农村妇女普遍文化程度不高且法律意识淡薄，在遭受家庭暴力之后不知道 该如何寻求救济途径，也不懂得怎样去及时固定相应的证据并采取法律措施保护自己， 最终导致某一天不堪忍受家庭暴力而向法院提出离婚请求时，由于无法对连续性的施暴 行为进行充分举证而导致不能达到自己的离婚目的。尤其是农村家庭暴力，更因其独有 的特殊性，在审判实践中表现出了诸多难点。本文笔者正是在这样的背景下，从一个基 层法律工作者的角度，对平日审理的农村离婚案件中普遍出现的家庭暴力现象进行调查 和分析，将其呈现出的原因和特点，以及该类案件在审判实务中出现的问题进行梳理， 并针对此类案件在审判实践中的难点提出个人的建议。 主题词 离婚纠纷 农村家庭暴力 审判实务 救济 1 Abstract In modern marriage,domestic violence has become a common phenomenon ,which impact the couple’s emotion and destroy the family’s harmony. Especially in many poor and backward rural areas ，females are used to be the victims of domestic violence.One of the subjective reasones is the deep-rooted patriarchal ideology that women are inferior to men, In addtion,women with the disadvantage in physical also be considered as an objective reason. As a local judge, the author heard part of divorce cases of rural couples ，concluded that the domestic violence was being the general cause of action. Most of these cases proceeded by the wife’s side ,who claimed being with experience of domestic violence. However,due to the low cultural level and the lack of legal consciousness , some female victims were not aware of asking for legal prtoction after sufferd from domestic violence. The lack of violence evidence always lead to an unexpected result of sentence for them. For some complex causes, a part rural domestic violence cases were hard to decided in practice.
