法学院课堂中的沉默不是金 ——开导 “沉默一族”学生主动谈论法律的若干策略 汪诸豪* （国家“2011 计划”司法文明协同创新中心、中国政法大学，北京 100088） 【摘要】自信的谈论法律是法律实务操作中一项重要技能，亦是在法学院 求学生涯中获得成功的利器。在法学院课堂上积极发言、主动谈论法律，是锻 炼口头表达能力的绝佳机会；而纵容学生在法学课堂上长期保持沉默，实则教 师对学生的伤害。许多有才华的学生因沉默而在课堂上遭到埋没，实则法学教 育的不幸。学生们在课堂中沉默的原因多种多样，但无论学生们难于开口发言 出于何种缘由，总有一些奏效的教学方法能开导课堂上 “沉默一族”在同学面 前开口谈论法律。其背后所体现的基本原理是：在公开场合反复训练学生们谈 论法律之能力可有效降低其开口时的焦虑感。 【关键词】主动谈论法律 苏格拉底式教学法 课堂参与度 To Keep Silence in Law School Class Is Not Wise Some Strategies to Lead Anxious Students Entering into Public Speaking About Law Zhuhao Wang (China “2011 Plan” Collaborative Innovation Center of Judicial Civilization, China University of Political Science and Law, Beijing 100088) [Abstract] To talk about law in confidence is an important skill in legal practice, while it is also an effective study tool to achieve success in law school. Actively speaking up in classroom is a great opportunity to exercise the proficiency of public speaking; while indulging students’ incessantly keeping quiet in law school class hurts students. There are a lot of really talented students out there who kind of just get buried simply due to their silence in classroom and that is really unfortunate. Various reasons lead to some students not speaking in class, but whatever the sources of their reluctance to speak, there is got to be some way that teachers can push students, in a gentle way, to talk about law in public. The underlying assumption is that repeated exercise into public speaking about law will reduce the student’s anxiety about each time rising up voice.
