论城市美观还是给小摊贩生存权 摘要 目前，遍布人潮之中的小摊贩与监督城市美观这一重要职责的城管部门之间的矛盾越来越激烈，城管部门“暴力”和“被暴力”的现象层出不穷，这样的行为于小摊贩，于城市监管都十分不利，“暴力执法”与“被暴力执法”都严重侵害了公民的人生财产权利，也会降低政府的威信，加大城市监督的压力，甚至有可能让影响城市美观的问题转化为社会不安的因素。针对这种情况，本文将对小摊贩由来已久的生活根基及其与城管部门之间的矛盾做深层次的分析，提出一些建议，以此形成一套适应我国国情的城市管理方法。本文将分为五个部分： 第一部分为引言， 总述小摊贩跟城市美观之间的矛盾问题，提出本文探讨的必要性与思路 第二部分，对小摊贩的生存状况以及其存在造成的社会负担做一定的介绍 第三部分，对城管部门执法期间存在的问题以及管理方式进行反思 第四部分，分析城管部门与小摊贩之间应如何协同实现“城市美观”的目标 第五部分，总括城市美观和小摊贩生存权共存的契机 【关键词】城管 小摊贩 执法 生存权 The?city?appearance?or to the?small vendors?survival right Abstract At present,?the contradiction between?the?small vendors?throughout the?crowd?and supervision of?city?appearance?which is one of the most important?responsibilities of the?urban management department?is becoming more and more fierce,?the urban management department?violence and emerge in an endless stream?of violent?phenomenon,?such behavior?in?small vendors,?in the?city?of supervision?are very negative,?violence law enforcement?and?violent?law enforcement?seriously?violated citizens?life?and property rights,?but also?reduces?the credibility of the government,?increase the?supervision of the?city,even?has the potential to?affect the city appearance?problem into the?factors?of social unrest.In view of this situation,?the contradiction between?the?long-standing?of?small vendors?and urban management department?life foundation?and?makes a deep analysis,?and puts forward some suggestions,?in order to?form a set of?adaptation to the situation of our country?citymanagement method.?
