全球电子商务中知识产权的保护 摘要 知识产权是公民、法人或其他组织对其智力劳动成果依法享有的占有、使用、处分和收益的专有权利。随着因特网在全球的迅速发展和广泛应用，电子商务受到人们越来越多的关注，并渗透到人们生活的每个角落，改变着社会的各个方面，传统的知识产权法面临着如何认定电子商务中的侵权行为以及如何保护电子商务中出现的新的知识产权等问题。在电子商务的知识产权中也逐渐产生越来越多的纠纷。如何维护电子商务中的权益成为人们越来越关注的问题。通过建立和完善知识产权保护制度和加强知识产权国际保护的协调工作，能够促进全球电子商务的良好发展。本文从电子商务的概念和发展现状等基础理论探讨入手，分析了电子商务中知识产权的特点以及二者之间的联系；阐述了在电子商务中遇到的知识产权并详细分析了它们涉及的问题；最后针对电子商务的发展现状，通过结合相关法律理论提出了相应的保护策略。 关键词 电子商务；知识产权；知识产权保护 Abstract Intellectual property rights are citizens,legal persons or other organizations,the results of their intellectual work are legally entitled to possession,use,dispose of and the exclusive right to the proceeds.With the Internet,the rapid global development and wide application of e-commerce more and more people are concerned about,and penetrate into every corner of people’s lives,changing all aspects of society, the traditional intellectual property law is faced with how to identify electronic violations of business and how to protect e-commerce in the emergence of new intellectual property rights and other issues.Aspects of Intellectual Property Righes in e-commerce is also emerging more and more disputes.How to protect the interests of e-commerce has become a growing concern.Through the establishment and improvement of intellectual property pyotection system and strengthen the coordination of the international protection of intellectual property rights work,to promote the sound development of global e-commerce.In this paper,the concept of e-commerce and development to exlore the status quo,such as starting with basic theory,analysis of the characteristics of e-commerce and intellectual proerty rights in the link between the two;on experience in e-commerce and a detailed analysis of the intellecual property involved in their issues;the final status for the development of e-commerce,through a combination of legal theory related to the protection of the protection of the corresponding stategy.
