劳动报酬权论文：论劳动报酬权的法律保护 【中文摘要】劳动报酬权是公民的一项基本人权和财产权,历来受到我国政府的高度保护。尤其是进入二十一世纪,随着经济快速增长,科学发展观、和谐社会建设的提出和人权入宪,将我国劳动报酬权的法律保护推升到一个崭新的高度。面对社会经济发展和国家政策的要求,当前我国劳动报酬权保护现实与需求之间差距越拉越大的,在时代呼唤下,国家加大了劳动报酬权的保护,制定了《劳动合同法》,并针对拒不支付劳动报酬行为规定了拒不支付劳动报酬罪。本文以拒不支付劳动报酬入刑为视角,剖析了劳动报酬权的内涵、该罪的时代背景,分析了本罪得以成立的法理依据,认为拒不支付劳动报酬行为危害了国家对劳动报酬权的保护制度,诱发了一系列不稳定不和谐的社会问题,促使社会反思劳动报酬权法律保护缺位对遏制拒不支付劳动报酬的影响。立法机关顺应历史和民意,增设拒不支付劳动报酬罪,使国家保护劳动报酬权特别是弱势农民工报酬权、惩治拒不支付劳动报酬,有了更完备的法律制度。同时应正确认识到,国家工作重点应继续放在治理上。对此,法律应当发挥作用,注重发挥刑事、民事、行政和民间调解的整体合力,既要考虑对劳动者特别是农民工的人性关怀,又要给企业以喘息的机会,在两者利益保护中把握平衡点。 【英文摘要】Remuneration for labor rights is a basic human rights of citizens and property rights, our government has always been a high degree of protection.
