电子合同法律问题的对策研究.doc

摘 要 随着数字化技术的高速发展，在全球范围内出现了新的交易方式电子商务。电子合同是电子网络技术与商务活动相结合的产物，也是一种新型的合同，对传统民商法带来一定的冲击与挑战，随之而来许多新问题需要解决和完善。 本文的内容主要是介绍电子合同的特征，与传统合同做对比，分析两者的优缺点，通过对国内外现存的相关法律法规和法律性文件以及案例的分析，在此基础上指出现在的电子合同存在的不足之处，包括电子合同的效力问题、电子合同主体资格的认定问题、电子合同的履行问题、电子合同的电子签名问题、电子合同的证据问题、 B2C中出现的霸王条款问题等问题。根据自己对电子合同的理解提出一些办法来应对出现的问题，例如电子合同订立的程序，规范电子合同有效所需的签名、盖章，有效防范电子合同的交易风险。 关键字：电子商务 电子合同 合同法规  Abstract With the rapid development of digital technology, the worldwide emergence of new forms of e-commerce transactions.
