山西师范大学文理学院本科毕业论文 浅析胎儿利益的人权保护 姓 名 段 全 系 别 政法系 专 业 法 学 班 级 法学0801班 学 号 0890020113 指导教师 安 晖 答辩日期 成 绩 浅析胎儿利益的人权保护 内容摘要 胎儿利益的人权保护长期以来一直是一个重要的法哲学问题，然而对此问题的学术探究仅局限于民法等相关法律领域。随着人权理论的不断向前发展，人权的主体逐渐关注于胎儿，胎儿的人权主体资格即胎儿是否享有权利能力已成为当前学术理论界一个新的热点问题。从人类人权的角度来探究胎儿的利益保护问题，将胎儿权纳入人类人文关怀和道德伦理的范畴，希望能通过立法保护胎儿的本身利益和权利，这是人权理念的最终目标。 本文试图通过对胎儿法理内涵的阐述和对其性质的学理基础的探究，并结合人权基础上胎儿基本权利的论述及我国目前对胎儿人权保护的现状，提出建立和完善我国对胎儿利益人权保护的立法对策及建议，以期能为我国胎儿人权的发展状况和建立完善的人权机制提供有力的保障，从而维护人权。 【关键词】胎儿权利 人权 计生政策 堕胎 Analysis of fetal interests of protection of human rights Abstract Fetal interests of protection of human rights has long been an important philosophy of law, however, this issue of academic inquiry is limited to civil law and other related areas of law. With the continuous development of human rights theories, the main body of human rights is increasingly concerned about the fetus, the subject qualification of the human rights of the fetus, fetal rights capacity has become a new hot issue in the academic sector. Of human rights point of view to explore the interests of the protection of the fetus, the fetus into a human humane care and ethical scope of legislation to protect its vital interests and rights, the enhancement of human value, the ultimate goal of the concept of human rights.
